Kimi is an intelligent guy.. But maybe he is a "pushover" and Jenni gets her way... And she is seeing how far she can push the boundaries.
Kimi needs to show her this is not reality..
It could just be that they are completely over each other, and they dont really care what the other does. They could still get along to some degree. It seems like they have grown apart, perhaps they have just accepted it and moved on. Usually there is more spite when there is still feeling involved, and then you wouldn't lend your boat out. It just seems like they have move apart.
On the other hand if they actually start divorce proceedings, it could count as an advantage for Kimi if he can prove that he has done everything he could in good faith.
